Family Law - Equitable Distribution


In Pennsylvania, marital assets, debt and property are divided by equitable distribution. This means that the court will distribute the assets, debts and property in a way that is most fair to the parties. This does not necessarily mean that each spouse gets an equal distribution.

Marital assets, debts and property are all assets, debts and property that are acquired from the date of marriage until either the date of filing for divorce, the date of separation or the date of distribution.

How does Equitable Distribution work?

First, the parties conduct discovery to determine which assets, debt and property are marital property and which are not.

Second, once the assets, debt and property subject to equitable distribution are identified, a monetary value is assigned to each asset and debt.

Finally, the assets, debt and property are distributed in a way that the court determines is just and fair given the circumstances of the parties.
